Budget Follow-Up: The Permit Extension Provisions In The Fiscal Code Bill

Last minute additions to Senate Bill 1042 (Browne-R-Lehigh) making changes in the Fiscal Code also include provisions outlining a process for environmental, planning and other permit extensions for developments caught in the economic downturn.

            Although based on formerly Senate Bill 569 (Pileggi-R-Delaware) and House Bill 1056 (M.O'Brien-D-Philadelphia), the language in the Fiscal Code bill is broader than either of those bills.
            A recent posting on the Pennsylvania Brownfields & Environmental Law Blog published by Joel Bolstein at Fox Rothschild outlines the provisions and the potential impacts.
            In addition, the Department of Environmental Protection has until August 5 to publish notice of a policy implementing these provisions.
