DEP Acts To Repeal Unlawful Mercury Rule Covering Coal-Fired Power Plants

On August 31, the Environmental Quality Board voted to approve a rulemaking repealing the Pennsylvania-specific rule setting limits on mercury emissions from coal-fired power plants.
           The final-omitted rulemaking was necessary as a result of a 2009 PA Supreme Court decision saying the rule was "unlawful, invalid and unenforceable."
            The controversial rule was adopted in 2006 after a nasty public campaign and as the centerpiece of the Rendell Administration's environmental agenda at that time.
