The Independent Regulatory Review Commission took action to deny an Environmental Quality Board final regulation on explosives. The Environmental Quality Board publishes a final regulation on incidential removal of coal. This week the Independent Regulatory Review Commission disapproved a final-omitted rulemaking proposed Commissioners expressed concern the regulation did not go through the normal public review process, but was instead taken directly to final form. Local officials and representatives of the fireworks industry objected to the changes. DEP now has 40 days after it receives formal notice from IRRC to respond to its concerns.
