On Thursday the Independent Regulatory Review Commission voted to approve final regulations increasing noncoal mining permit fees after the package was resubmitted to the Commission by the Environmental Quality Board without change.  The Commission had disapproved the regulation in June saying they imposed to much of a burden on the industry.

Technical Guidance & Permits

The Department of Environmental Protection published a notice rescinding polices related to aboveground tanks and air quality source monitoring, notice of certification requests under the Nutrient Credit Trading Program, notice of availability of a draft NPDES General Permit for Stormwater Discharges Associated with Construction Activities (PAG-02), a notice suspending enforcement of a small portion of the Stage II vapor recovery regulations and a notice updating the list of companies certified to perform radon activities (PA Bulletin page 5432).

The Public Utility Commission published a notice of its order to implement the DSIC infrastructure improvement charges program and a notice adopting Phase II of its Act 129 Energy Efficiency and Conservation Program.

DEP Rescission: DEP ID: 257-2318-005. Policy for Implementing the General Operating Permit Strategy for Aboveground Storage Tanks. This Technical Guidance Document was created in 1997 as the initial guideline to implement the regulation of aboveground storage tanks through general operating permits.

DEP Rescission: Interim Procedures Pertaining to Continuous Source Monitoring System Quarterly Data Reports. The interim guidance outlines procedures the Department utilizes whenever Continuous Source Monitoring System Quarterly Data Reports required under 25 Pa. Code § 139.101(5) (relating to general requirements) are inaccurate or not submitted.
