IRRC Submits Disapproval Order To PUC On Final Net-Metering Regulations

The Independent Regulatory Review Commission Thursday submitted its formal disapproval order on the Public Utility Commission’s net metering regulations the IRRC unanimously disapproved on May 19 saying they are not consistent with statutory authority.

The regulations, which narrowly passed the PUC in February, would have limited the size of solar systems and other sources of renewable generation systems that customers could install.

The regulations would have further discouraged new generation by increasing the administrative burden on installers and open the door to new fees.

The PUC now has three options in responding to the disapproval order: withdraw the regulation (or take no action), resubmit the regulations with changes within 40 days of the receipt of the order or submit the regulation without changes to the IRRC and the General Assembly.  The IRRC then has one last opportunity to vote on the regulations and the General Assembly has the option to pass a concurrent resolution disapproving the regulation.
