EHB Again Denies Temporary Supercedeas In Appeal Of Mariner East 2 Pipeline Permits

The Environmental Hearing Board Thursday denied a second request for a temporary supercedeas and an expedited hearing by environmental advocacy groups appealing DEP’s issuance of 20 permits for Sunoco’s Mariner East 2 natural gas liquids pipeline.

A temporary supercedeas would have prevented Sunoco from beginning construction of the pipeline until the merits of the case were decided.  Sunoco is still waiting for additional permits for the project from the U.S. Army Corps of Engineers.

In an opinion denying the request, the Board said the appellants did not present any information not previously considered by the Board to justify reconsideration of the decision not to grant the supersedeas.

A full hearing on the supercedeas request is scheduled to begin on March 1.
