The Environmental Hearing Board denied a request for a supercedeas by environmental advocacy groups appealing DEP’s issuance of 20 permits for Sunoco’s Mariner East 2 natural gas liquids pipeline on March 3.
The action comes after two earlier requests for a temporary supercedeas and expedited hearing were denied.
A supercedeas would have prevented Sunoco from beginning construction of the pipeline until the merits of the case were decided.
The decision on the supercedeas was announced verbally from the bench and no written opinion has been posted.
A hearing on the merits of the case (#2017-009) does not yet appear on the EHB Hearing Schedule. The schedule in the pre-hearing order from the Board has discovery ending August 23, all motions filed by September 22 and a hearing sometime after that.
Sunoco said during the supercedeas hearing before the EHB it hopes to have construction completed on the one of the two pipelines covered by the DEP permits by the end of September. Sunoco said construction of the second pipeline will go into early 2018. Both pipelines are traveling along the same route.
