PA Oil & Gas Industrial Facilities: Permit Notices, Opportunities To Comment - July 13

The following notices were published in the July 13 PA Bulletin related to oil and gas industry facilities.  Many of the notices offer the opportunity for public comments.

-- Beech Resources, LLC - Two 16-inch Water Pipelines, One 16-inch Gas Pipeline: DEP invites comments on a Chapter 105 application for three pipelines impacting Beauty’s Run (Exceptional Value), several Exceptional Value wetlands and floodways located in Lycoming Twp., Lycoming County. -- Hummel Station, LLC - Natural Gas-fired Power Plant: DEP invites comments on a Title V Acid Rain Air Quality Permit for the facility located in Shamokin Dam Borough, Snyder County. A hearing will be held August 14, if requested, at the DEP’s Northcentral Regional Office in Williamsport at 1:00 p.m.   (PA Bulletin, page 4044Read more here.

Land Recycling/Brownfield Cleanups

-- Diversified Production, LLC - Krajewski 5 Gas Well: DEP approved a Final Report on remediation of soil contaminated with wastewater containing aluminum, barium, boron, chloride, iron, lithium, manganese, selenium, strontium, vanadium, and zinc to meet the Statewide Health Standards at the pad located in Winslow Twp., Jefferson County.   (PA Bulletin, page 4076)

-- Buckeye Pipeline Lancaster Junction: DEP issued a technical deficiency letter on a Final Report on the remediation of soil contaminated with unleaded gasoline to meet Site-Specific Standards located in Manheim Twp., Lancaster County.  (PA Bulletin, page 4076)

2024 Land Recycling/Brownfield Cleanups

So far in 2024, DEP received or acted on 166 Act 2 Land Recycling notices related to oil and gas facility site cleanups.

Air Quality Permits

-- Repsol Oil & Gas USA, LLC: DEP issued a renewal of an Air Quality Permit for an Unknown facility in Apolacon Twp., Susquehanna County. (PA Bulletin, page 4079)

-- EQM Gathering OPCO, LLC - Callisto Compressor Station: DEP issued an Air Quality Plan Approval for the modification of an air pollution source at the facility located in Morris Twp., Greene County.  (PA Bulletin, page 4079)

-- UGI Energy Services, Inc. - Compressor Station, LNG Gas Facility: DEP issued a renewal of a State Only Air Quality Permit for the facility located in Washington Twp., Wyoming County. (PA Bulletin, page 4080)

-- Texas Eastern Transmission, LP - Compressor Station: DEP issued a renewal of a State Only Air Quality Permit for the facility located in Bedford Twp., Bedford County. (PA Bulletin, page 4081)

-- Tennessee Gas Pipeline Company, LLC - Compressor Station 313: DEP issued revisions to a Title V Air Quality Permit incorporating presumptive RACT requirements for the facility located in Hebron Twp., Potter County. (PA Bulletin, page 4081)

Individual NPDES Stormwater Permits

-- Texas Eastern Transmission LP - Holbrook Compressor Station: DEP invites comments on the renewal of an Individual Stormwater NPDES permit impacting North Fork Dunkard Creek, including provisions to report PFOA chemicals, located in Richhill Twp., Greene County.  (PA Bulletin, page 4030)

Chapter 105 Encroachment Permits

-- CNX Green Ventures, LLC - 822 Acre Blacksville Mitigation Bank: DEP approved the Section 401 Water Quality Certification for the project located in the Dunkard Creek Watershed, Wayne Twp., Greene County. (PA Bulletin, page 4085)

-- Snyder Brothers, Inc. - Unknown Project: DEP issued a Chapter 102 permit for a project impacting the Cowanshannock Creek in Kittanning Twp., Armstrong County.  (PA Bulletin, page 4088)

-- Stonehenge Laurel Gathering, LLC - Burns Farms-Windy Oakland Pipeline: DEP issued a Chapter 102 permit for the project impacting the Clarion River and Dunlap Creek located in Perry and Licking townships, Clarion County.   (PA Bulletin, page 4088)

Act 14 Notices To Municipalities

Many communities and citizens are not aware that a state law passed in 1984 gives them the first chance to comment on Department of Environmental Protection permit applications even before they are submitted to the agency.   Read more here.

Act 14 requires applicants to submit notices to municipalities and counties for air quality, water obstruction (Chapter 105), any permit issued under the Cleans Streams Law (including Chapter 102, stormwater, NPDES, many more), any solid waste and hazardous waste, land recycling and water allocation permits.

These notifications, sent by registered mail, must give municipalities and counties at least 30 days to comment to DEP and in the case of solid waste and hazardous waste at least 60 days, according to the law.

Without proof Act 14 notices were sent to municipalities and counties within the required timeframe, a DEP permit application is not complete and DEP cannot review it.

And the notices must be sent each time an applicant wants to modify, renew or expand what their applications cover, so there can be a lot of them.

For those interested in the oil and gas industry, these notices cover almost every aspect of developing oil and gas drilling well pads and all gas infrastructure-- pipelines, gas processing plants, water and wastewater storage facilities, pigging and metering stations and more.
