PA Oil & Gas Industrial Facilities: Permit Notices, Opportunities To Comment - February 15

The following notices were published in the February 15 PA Bulletin related to oil and gas industry facilities.  Many of the notices offer the opportunity for public comments.

-- The Governor’s Office published an updated agency-by-agency Regulatory Agenda in the February 15 PA Bulletin that lists regulations in development, an estimated schedule of consideration and opportunities for public comments.  Read more here.

            For DEP, the Agenda includes a proposed regulation establishing an annual permit fee for shale gas wells [Read more here] and updated waste management regulations covering conventional oil and gas operations [Read more here].

            Also included is an update of the Residual Waste Coproduct regulations to “ensure that the efficacy of a waste for a particular use and the consistency of the process” are demonstrated as part of the coproduct determination.  Read more here.

-- The Susquehanna River Basin Commission published notice in the February 15 PA Bulletin announcing its next business meeting on March 13 to consider water withdrawal requests-- including six shale gas development withdrawals-- a new general permit for into basin diversions of water and other agenda items. -- DEP published notice in the February 15 PA Bulletin announcing a March 20 hearing on a new NPDES Water Quality Permit for the Westmoreland Sanitary Landfill in Rostraver Township.  Read more here.

Land Recycling/Brownfield Cleanups

-- EQT Corporation - Kentor Shale Gas Well Pad: DEP approved a Final Report on remediation of soil contaminated with production wastewater (aluminum, barium, boron chloride, iron, lithium, manganese, selenium, strontium, vanadium, zinc) to meet the Statewide Health Standards at the pad located in Center Twp., Greene County. 2025 Act 2 Oil & Gas Facility Pollution Cleanups

So far in 2025, DEP received or acted on 19 Act 2 Land Recycling notices related to oil and gas facility site cleanups.

Air Quality Permits - Comments

-- Constellation Energy Generation LLC - Eddystone Gas/Oil Power Plant: DEP invites comments on the renewal of a Title V Air Quality Permit for the facility located in Eddystone Boro, Delaware County. (PA Bulletin, page 1556)

-- Hamilton Liberty LLC - Gas-Fired Power Plant: DEP invites comments on an Air Quality Plan Approval for changes to the facility resulting in a 36 MW increase in generating capacity for the facility located in Asylum Twp., Bradford County.  (PA Bulletin, page 1558)

-- MarkWest Liberty - Bluestone Natural Gas Processing Plant: DEP issued a 6-month extension of the plan approval to allow DEP more time to inspect the facility to determine plan approval compliance at the facility located in Jackson Twp.,  Butler County. -- Range Resources - Orenchuk Russell Shale Gas Well Pad: DEP issued a de minimis increase in air emissions covering multiple sources of air pollution under a GP-5A General Air Quality Permit at the facility located in Jefferson Twp., Washington County.
